How to Trademark a Business Name

So you want to protect your company name? It is relatively simple and inexpensive to do so. Following the simple instructions will get you going in the right direction.

Things You’ll Need:

  • Internet connection
  • Printer
  • Fee
  • Notary

Step1
Go on-line to the Secretary of State web site for your state. Click on business services.
Step2
Follow the links from Business Services to Tradenames & Trademarks. Before searching to see if your chosen business name has been taken, do not include your corporate status - i.e. LLC, Corp., etc. Specific guidelines are included as a separate link - I suggest you read these over before settling on a specific name.
Step3
Once you have settled on a name, click on Search for Registered Names. If your chosen name is not already registered, you will receive a message that "No Record Found."
Step4
When you receive this message, return to the Tradenames & Trademarks page. There are links to Fees and Forms. Print out the registration form, have it notarized and then mail it with the appropriate fee to your Secretary of States office.
Step5
In approximately 4-6 weeks you will receive your state license. Your trade name registration is good for up to 10 years, depending on your state.
