"Your spouse is in prison and you want a divorce. Hi, I'm Robert Todd, and I'm here to answer the question. How do I divorce an inmate? Well, contrary to popular belief, that inmate cannot prevent you from obtaining a divorce. In all fifty states, there is now a concept known as no fault divorce, and you simply have to file the appropriate papers. Even if your spouse who is an inmate objects, they cannot stop that. Now, not only do you need to file the appropriate paperwork, which in most states would be a petition for divorce or a petition for dissolution of marriage, but you need to be sure that your spouse who is an inmate is served with the copy of those pleadings. All of a law in all fifty states requires that the inmate spouse be served with the papers. I'm Robert Todd, and thank you for watching."
