How to Calculate Long Service Leave in NSW

To qualify for Long Service Leave in New South Wales, you must be employed by the same employer for at least 10 years. If your company is acquired by another corporation due to sale or merger, you still qualify for long service leave. If you are promoted or take on another role within that company, your status for leave is not affected.

Instructions

    • 1

Calculate the number of years you have worked for your employer. If you have been consecutively employed for 10 years, you are entitled to 60 days of leave. For every additional 5 years you work for the same employer, you are entitled to an additional 30 days of leave.

    • 2

Open the Long Service Leave Calculator to establish the exact time frame in which you have been employed (see Resources).

    • 3

Select the start date by choosing the "Day," "Month" and "Year" within the drop-down menu.

    • 4

Select the end date (or today's date) by choosing the "Day," "Month" and "Year" within the drop-down menu. Select "Next." A new screen will appear to tell you exactly how much Long Service Leave to which you are entitled.

Tips & Warnings

  • If you have taken other types of approved leave, you have not broken continuity of service, although some types of leave (such as parental leave) may not count as days worked.

  • If you have worked for five years and must resign because of illness or a pressing necessity, or if you are dismissed except for serious misconduct, you are entitled to a pro-rated paid leave.

  • Some jobs may be exempted by the government of New South Wales from providing Long Service Leave. Check with your employer.

  • You may take leave only after receiving permission from your employer. You will not be compensated for the leave without taking it, but in some situations you may receive payment before leave time is completed.
