How to Register a Business Name in Texas

Texas makes it rather simple to register a business name. The most difficult part will be deciding on a name for the kind of company you are starting. You'll want something that is original and distinct from all other companies. Make the name easily recognizable and easy to remember. Make it your own and then register it with the city where you live in Texas so that no one else can use it.

      Go to the nearest county clerk in Texas. You will be asked to look through names in a book in order to find if the name is already taken. If so, you will need to select another name and see if that is already taken. It is best you arrive with several names in mind. A worker will look up the name of your choice in the computer system to find out if there is anything else resembling the name. The county clerk employee will ask if you want to remain with the same name if there are other similar companies with similar names. It is usually best to have a name that is distinct from the others.

      Fill out paperwork. You will need to report if you are a sole proprietor or if you'll have a partnership. Perhaps the business will be considered a corporation, which would be run by more than two people.

      Obtain an EIN number. You can do this by filling out a form called the SS4 on the IRS website and mail it in. Once you receive your number, then you will need to add it to your registration form at your nearby Texas county clerk.

They will mail you official forms to have proof that your chosen name for the business is yours.
