Federal and state law does not require an employer to give paid vacation time to employees. Many employers choose to give paid time off as a reward and as a way to keep employees. Depending on the state, state laws may regulate vacation pay.

  1. Form of Wages

    • In some states, vacation pay is a form of wages since an employee accumulates vacation time according to the number of hours worked. An employee is usually entitled to payment for the remaining vacation days upon the termination of employment.

    State Limitations

    • If an employer chooses to provide an employee with vacation time, certain restrictions may apply. A state can regulate how an employer can calculate vacation hours or what workers an employer can exclude from receiving the vacation benefit.

    Paid Time Off

    • Some companies combine vacation time and sick leave in a system called Paid Time Off or PTO. The employee receives a combined number of sick days, vacation time, and personal days each year. When the employment ends, the employer must pay the employee for the unused days.
