"To legally file the name of the business, you must make sure that the business name is available. Check with your Secretary Of State's office to determine if the name is available. Your business name must be distinguishable from any existing business. That includes an LLC, a partnership, a limited liability partnership. A corporation and Escorp and DBA and or a non-profit organization. Once you have determined that your name is distinguishable. Then we can move to the next step. Generally a name is distinguishable if it is a difference of a few words. For instance, ABC Tire and ABC Brakes and Tires are two different companies. So we want to make sure that you are keeping your name very distinguishable from another business. If you choose to register the business name formally through the incorporation process. Go ahead and check with your Secretary Of State to determine which is the best way. Once you have decided upon the name, it's always good to check with an attorney or a CPA. And follow their instructions."
