"As an employer you want to make sure that when you fire somebody that it's legal. My name is Gloria Campbell, I'm with Advances Training Systems in St. Petersburg, Florida and I want to tell you how to make sure that you fire an employee legally. The first thing you want to do is you want to understand what are the rules and regulations for your state. Some states are right to work state, which means that an employee has no right to work except at will. There are however federal statutes that apply. And here are some of the reasons that you legally cannot fire someone because of age, because of race, because of gender or because of sexual orientation. Other than that, if an employee has accepted responsibility to do a job and they're not doing their job, their not showing up on time, they're not performing that job to the level of satisfaction that you desire as an employee, you have a right legally to fire them. Now word of caution, make sure that you've documented everything that you've done. Make sure you've documented when you've counsel that employee, make sure that you've documented or observed things that that employee have not done that should have been done. The thing also I would say is that if you catch an employee stealing, or you catch an employee that is illegal within your organization, fire them immediately, document it and make sure that you get them out of your place of employment as quickly as possible. Good firing, if you fire somebody for the right reasons, you'll always have the law on your side.
