"You have a dispute and you want to go to small claims court. Hi, I'm Robert Todd, and I'm here to answer, How do I take someone to small claims court? Well basically the first question you have to answer is, the amount that is in controversy, how much are you arguing with this other person or entity about. Small Claims Court jurisdiction amounts vary from state to state, and it changes from year to year. So you want to check with your local authorities, your local courthouse to find out what the jurisdictional amount is for Small Claims Court in your area. Once you do that, you can go down to the clerks office and you can find and locate the paperwork that you're going to need to file a claim. You're going to allege what dispute has occurred, who the person is with whom you have the dispute, and you're going to file it, there will of course be a filing fee. Ultimately you're going to have some sort of pre-trial, which you must attend, or your small claims case is going to be dismissed. And you're ultimately going to have to go to a hearing where you're going to put on evidence, the person with whom you're having a dispute is going to put on evidence, and a judge is going to make a decision.
