You've come to the decision that you may need to consider divorcing your spouse. It's a very somber moment, but you don't know where to begin or how to start. Hello, I'm Robert Todd, and I'm here to answer the question: How to start a divorce. Well, first of all, remember that the law governing divorce is going to vary from state to state. All 50 states have their own laws with respect to that divorce, so the first thing you want to do is check your particular state where you're living and determine what the divorce laws are in that state. In many states, they have self-help kits. You can go online and see if you can follow those forms or you can go to a local courthouse and see if they have kits available. Review that kit, and see if you understand the terminology and the process. If you and your spouse are agreeable, then many times, a self-help kit is just what you're looking for. If you're not agreeable, then you may need to seek the services of a family law attorney, and that would be both of you would have to seek the services of an attorney because one attorney cannot represent both parties.
