DUI Laws in Billings, Montana
In Montana, including the city of Billings, any person with a blood alcohol concentration (BAC) of 0.04 or more is at risk for a driving under the influence (DUI) arrest depending on the circumstances. Drivers with a BAC of 0.08 will be arrested for DUI. Drivers under the legal drinking age of 21 years will be subject to arrest if the BAC is 0.02 or more. Commercial drivers are subject to arrest if their BAC is 0.04 or more.

DUI Under 21 Years of Age

A person under the age of 21 years of age who is arrested for driving with a BAC of 0.02 or more is subject to a fine of $100 to $500 for the first offense. If a person is convicted of a second underage DUI, the fine will be $200 to $500. If the person is over 18 years of age, he will spend up to 10 days in jail. For a third conviction, the person will be fined $300 to $500. Drivers over 18 years of age are subject to at least 24 hours to 60 days in jail.
Ignition Interlock Device

In Billings, Montana, a person may be ordered to install the ignition interlock device in her car for a first, second or third time DUI. A person that applies for a probationary license for the first, second or third offense DUI, will need to install the device in order to drive with the probationary license, which is used to get to work or school and home. The driver is responsible for fees of maintaining the unit, leasing the unit and installation of the unit.

First Offense Driving Under the Influence

The first conviction for a DUI will result in 24 hours to six months in jail, a fine of between $300 to $1,000 or $600 to $2,000 if a passenger under the age of 16 years old is in the vehicle. The driver's license is suspended for six months, but a probationary license is possible right away with ignition interlock. Court ordered chemical dependency education and/or treatment is required.
Second Offense Driving Under the Influence

The second DUI offense in Billings, Montana will result in a fine of $600 to $1,000 with seven days to six months in jail or $1,200 to $2,000 and 14 days to 12 months in jail with a passenger under the age of 16 years in the vehicle. The driver's license is suspended for one year and a probationary driver's license is possible after 45 days with the ignition interlock installed or the vehicle can be confiscated and forfeited. The court will order chemical dependency education and/or a treatment program.
Third Offense Driving Under the Influence

The third conviction DUI will result in 30 days to one year in jail and a fine of $1,000 to $5,000 or if a person under 16 years of age is in the vehicle, jail time can be 60 days to 12 months and a fine of $2,000 to $10,000. The driver's license is suspended for one year with a possibility of obtaining a probationary license after 45 days with the installation of the ignition interlock or the vehicle can be seized and forfeited. A chemical dependency course will be ordered and/or treatment.
