First Offense DUI Penalties in Arizona
In Arizona, a person driving with a blood alcohol concentration of .08 or more will be arrested for DUI. For a person under the age of 21 years, no alcohol concentration is allowed. A commercial driver cannot have a blood alcohol concentration of .04 or more. Penalties for the first offense can be costly with fines, assessment fees, insurance and other penalties.

Ignition Interlock Device

The ignition interlock device, which prevents a vehicle from starting if the person has any alcohol in his system, can be ordered for the first time DUI conviction. If the person blows into the device and the system does not detect any alcohol in the driver's system, the device allows the vehicle to be started. The expense of the device is the responsibility of the offender.
SR22 Insurance

SR22 insurance is ordered for the first DUI conviction before the driver's license can be reinstated. You must keep the SR22 insurance for three years from the date of your driver's license suspension date. The SR22 insurance shows that you have enough financial responsibility to drive on the roads of Arizona. Financial responsibility means automobile insurance with at least $10,000 for property damage and $15,000 for bodily injury for one person and $30,000 for two or more people.

Fines and Related Costs

The fines and other costs include a fine of $250 and the DUI surcharge for Arizona of $200. There is a probation charge of $10 and $500 for the prison construction assessment. An additional $500 is ordered for the Xtra DUI assessment. Additional fines are imposed if a person under 15 years of age is in the vehicle when the arrest is made or if an accident occurred with bodily injury.
Jail and License Suspension

The first DUI conviction can result in 24 hours to 10 days in jail and a license suspension of between 90 days and 360 days. Additional jail time can be added for having a person under the age of 15 years of age in the vehicle at the time of arrest or if the driver causes an accident with bodily injury.
