Wedding Laws in the State of Florida

Wedding Laws in the State of Florida thumbnail
Wedding laws vary for each state.

Marriage laws are determined on a state-by-state basis. The requirements for waiting time between getting a license and the wedding, the cost of the license and where you go to obtain the license vary. The laws in Florida do not require any blood tests or physical exams before a wedding can happen.

  1. Cost

    • As of December, 2010 the cost of a marriage license in Florida is $93.50. Couples can get a discount of $32.50 by attending a four-hour course that teaches communication, parenting and financial skills.

    Residency

    • Florida does not have any residency requirements for individuals before they can obtain a license. Someone can go to Florida from any other state and be granted a marriage license immediately.

    Waiting Period

    • While there is no waiting period to receive your license, the wedding cannot take place until 72 hours after the license has been issued. Couples who take the four-hour course are exempt from the three day waiting period. The license expires 60 days from the date of issuance.

    Age

    • Individuals must be 18 or older to get married without parental consent. The clerk will need to see a copy of your birth certificate to verify your age. If under 18, parental consent and a birth certificate are required. You cannot get married under the age of 16 without a court order. An exemption to parental consent exists if the individual is pregnant and the pregnancy is verified, in writing, by a physician.

    Prior Marriages

    • Both parties to the marriage need to provide information on prior marriages before the certificate is issued. The date of divorce or spouse's death needs to be supplied. You need to show either the divorce records or death certificate to the clerk.
