Private Swimming Pool Laws in Texas
The state of Texas has designed several laws for pool owners to ensure the safety of those swimming in a private pool. It's important for those home owners with a pool, or preparing to build one, that they take the necessary precautions to ensure residents enjoy swimming in a safe environment.

Barriers

Under state law, a pool barrier or fence must be in place to prevent children from entering the pool area unattended. The fence has to be a minimum of 48 inches in height. The fence must also have a barrier along the base of the structure, preventing an object 4 inches in diameter from entering the water.
Breakable Objects

It's illegal to have a breakable container, such as a glass or bottle, in or around the pool area. This is to prevent glass from entering the water. Home owners are encouraged to use unbreakable plastic containers.

Telephone

Pool owners must have a properly working telephone within 200 feet of the pool area. This is so they can call authorities if an emergency situation occurs. Cellphones aren't allowed; they can lose reception and restrict you from placing an emergency call.
Maintaining Safety

The Texas Local Government Code has the right to order a pool owner to repair any damage to her pool fence to ensure the safety of those swimming. The maximum fine for not following an order to repair a fence is $1,000.
