How to Terminate a Limited Guardianship in Michigan

A limited guardianship gives one person limited powers over another person in Michigan. The guardianship allows the guardian to make decisions for the ward, but decisions are restricted to the powers defined in the limited guardianship order. A minor child or an adult not capable of making all decisions for herself can become a ward in a limited guardianship in Michigan. A third party, such as the legal parent of a minor ward, can file in court for termination of the limited guardianship.

      Visit the Michigan county probate court that appointed the limited guardianship. Ask for the petition to terminate a limited guardianship.

      Complete the first part of the petition. You need the ward's full name, gender, race and current address. State the relationship of the petition to the ward, such as "parent." Fill in the guardian's name and address.

      Determine the nearest living heir to the ward, as necessary under Michigan law. List the spouse of the ward, if any. List any adult children of the ward if he has no spouse. List the remaining heirs, such as siblings or parents, if the ward does not have adult children or a spouse. Include the relationship, phone number and address for each heir.

      List the names and addresses of all persons interested in the care of the ward if the ward is a minor. Include names, addresses and telephone numbers of the minor's parents, current guardian and conservator, if any. State the name and address of any person who cared for or had custody of the ward in the last 63 days before the petition filing.

      State the reasons why the limited guardianship should be terminated. Select the box for the termination of limited guardianship on the form. Check the box that corresponds to the child's Indian status if the petition is for a minor ward.

      Sign and date the completed petition. Include the address and telephone number of the petitioner and the petitioner's legal representation, if any. Make three copies.

      Notify the Attorney General's Office if the ward has no heirs. Mail a copy of the finished petition to: Attorney General; Public Administration; PO Box 30736; Lansing, MI 48909.

      File the completed petition in the Michigan county probate court. Wait for the hearing notice.
