Legal emancipation is the process where a minor becomes free from the legal guardianship of parents or other caretakers. Minors may only become legally emancipated by a court decree, and securing a judgment is not necessarily a straightforward process. The minor must prove to the court he is mature, financially independent and able to live on his own. There must be a compelling reason to grant emancipation -- merely strict parents isn't enough. Also, the legal guardian or parents must consent to emancipation. Minors who seek emancipation should strongly consider hiring legal representation.

      Read through the requirements of legal emancipation to ensure you can meet each one before you begin the process. Look up the requirements in the Nevada Revised Statute, chapter 129.080.

      Compile the necessary contact information, including the full name and current address of the minor, and the full names and address(es) of the parents. In cases with a legal guardian, file the name and address of that person as well. If no parent or legal guardian exists, identify the minor's closest living relative who resides within Nevada.

      Make notes on the minor's relationship to his or her parents. Include how long the minor has lived apart from the parents or guardian and why.

      Gather facts related to the minor's education. This includes the school(s) attended, transcripts and any acceptance to a college or university.

      Write down proof of financial independence, including bank statements, proof of employment and employment history. This information is absolutely vital for a judge to approve emancipation, as parents and guardians are not legally bound to support an emancipated minor.

    Fill Out Petition

      Download and print out the Clark County Court's Petition to Emancipate a Minor form. Some parts can be filled out online, but others must be handwritten. Use black ink.

      Fill out the petition with the information you prepared. Complete every field to the best of your ability. Read through the entire petition form to learn if you must file any additional supporting documents, depending on your individual circumstances. Make a copy of your petition and supporting documents in case any get lost.

      File the petition with the Clark County Court's Family Division, located at the Family Courts and Services Center, 601 N. Pecos Road, Las Vegas. Expect to pay a filing fee consistent with the court's current fee schedule. Comply with the court's request of bringing a 10- by 13-inch envelope when you file.

      Wait to be notified of the date and time of the hearing. The minor, plus the parents, legal guardian or nearest relative, will be called, at minimum. If the minor has a probation officer, he or she also will likely be called. Expect to be questioned thoroughly about the petition, the reasons behind emancipation and your ability to living independently.

Tips & Warnings

  • Minors must be at least 16 years old to file for emancipation.

  • Legal aid may be available through a free or low-cost clinic, such as the Legal Aid Center of Southern Nevada. Clark County Court also offers a free "Ask a Lawyer" program.

  • Emancipated minors still must follow state laws in regards to not consuming alcohol until 21 years old and not working in the gaming industry before 18 years old.
