How to File an Embezzlement Complaint
Embezzlement is considered a white-collar crime that involves an employee who steals money from an employer. After discovering the theft, a manager usually confronts the employee suspected of embezzlement. Once it has been proven that the employee actually stole the money, the company can fire the worker as well as request that a criminal complaint be filed against him.

Hire a forensic auditor. A forensic audit is done to gather evidence that could be presented in a court case. The bank accounts and files kept by the person suspected of embezzlement would come under the scrutiny of a forensic auditor. This type of detailed information will serve to back up the company's embezzlement complaint.

Call an attorney specializing in labor employment law. After presenting the lawyer with the information about the fraud, the attorney will discuss steps the company needs to take to move forward with prosecuting the individual.

Interview the individual. Ask the person questions about his or her involvement in the crime. If there is more than one person involved, interviews can be done separately. Depending on the person's response, there may be a need to have more than one interview. The person suspected of embezzling money may have a criminal defense attorney present to protect his rights.

Call the local police department. A police detective must investigate the complaint and interview the managers making the embezzlement claim as well as the individual accused of stealing the money. The detective will also review the company's findings from its internal investigation. If there is enough proof that a crime was committed by the suspect, the individual will be arrested. The detective will also forward the complaint to the local prosecutor's office and ask the prosecutor to file embezzlement charges against the individual.
