How to File for an Appeal for Exhausted Unemployment in Illinois

When you apply for Illinois unemployment benefits, the Illinois Department of Employment Security (IDES) reviews your information to determine whether you qualify for benefits and the amount you can receive. If you disagree with the determination of when your benefits will be exhausted, you can appeal. However, if you wait until the benefits are exhausted, you can't appeal. You must contact the IDES within 30 days of the date on your notice of determination to appeal an exhaustion amount.

      Read the notice of determination thoroughly, paying special attention to the maximum benefit amount listed. Download the Notice of Appeal form from the IDES website.

      Fill out the form in its entirety, including signing it and dating it.

      Return the form to the IDES by mail, fax or in person to the address or number on the notice of determination within 30 calendar days of the date of the notice of determination.

Tips & Warnings

  • If you choose to mail your appeal form, the IDES uses the postmark date when determining whether you made the deadline.

  • If the appeal deadline falls on a day the IDES is closed, such as a weekend or a state holiday, you have until the next business day to file your appeal. If you miss the deadline for any reason, you must state it in the request. The IDES will only hear your late appeal if you can provide a reason that shows the delay was through circumstances beyond your control.
