How to Negotiate My Claim

How to Negotiate My Claim thumbnail
After an accident, negotiating an insurance claim can get you a better settlement.

When you are in an auto accident, working with the adjuster from your insurance company will be necessary so that you can get a fair settlement. During this process, you can simply take what the insurance adjuster offers or you can try to negotiate a better settlement. When you want to negotiate with the insurance adjuster, you will need to come prepared with information and be willing to wait for a better offer.

Instructions

    • 1

Keep all of your information from the auto accident in a central location. You should keep information about the other driver, estimates of the damage to your car, medical bills and anything else that is relevant. When you talk to the adjuster, you need to have access to all of this information. You should also keep notes from your conversations with the adjuster so you can refer back to them later.

    • 2

Wait on all of the medical bills to come in from the various medical providers before you consider settling. If you are in a serious accident and you need medical attention, you may receive bills from several different medical providers. If you settle the claim before one of the bills comes in, it could negatively affect your financial situation in the future.

    • 3

Receive the initial offer from the adjuster and consider whether it is fair. The insurance company will typically make an offer relatively quickly so it can try to get the claim settled fast. Do not rush to agree to the offer right away. Instead, take some time to evaluate it and make sure it covers all your expenses as well as pain and suffering.

    • 4

Write a demand letter to the insurance company and adjuster asking for a different amount if you are unsatisfied with the initial offer. When you write the letter, be sure to include exact information about why you are asking for more money. If you can verify the amount that you are asking for, the insurance company will be more likely to give it to you. Wait for the settlement offer and then do not settle until you are happy.
