Cancel a K-1 visa petition through the National Visa Center (NVC).

Stop the processing of a K-1, nonimmigrant visa for a fiancé, at any stage in the processing. The K-1 petition is submitted to the United States Customs and Immigration Services (USCIS) first where it is entered into its system. Once approved, the case travels to the National Visa Center (NVC) where it is pre-processed and then forwarded to the embassy in the foreign fiancés jurisdiction. You will not receive a refund for the processing fee paid when the visa was petitioned.

      Write or type a letter stating that you wish to cancel the petition along with a brief explanation of why you need it canceled. The letter must include the EAC number for your case, your full name as listed on the I-129, Petition for Alien Fiancé, and the beneficiary, your foreign fiancés name, each clearly identified.

      Leave an adequate amount of space after your closing for a signature. Do not sign the letter yet. Below the space needed for signing, print your name legibly or type it. When typing, four lines of space are generally enough for a signature.

      Print the letter if typed on a computer.

      Obtain notary services to verify your signature on the letter. The notary will watch you sign the letter then will place his seal on the letter for verification.

      Mail the letter to the USCIS. Tracking, delivery confirmation, registered mail or return receipt are recommended options available at the post office so you will know when the letter was received.

Tips & Warnings

  • If an interview has been scheduled with the fiancés embassy abroad, you will also need to include in your letter that you wish to withdraw your I-134, Affidavit of Support form, as well.

  • Forward a copy of the withdrawal letter to the NVC and embassy if the case has reached those offices to ensure no visa is issued before the USCIS has officially canceled the petition.

  • If the visa has already been issued, it will automatically expire 90 days after the fiancé enters the United States. The fiancé will not be able to pursue citizenship if he does not marry the petitioner.
