How to Write a Legal Declaration in Florida
Under Florida law, wills, living trusts, bankruptcies, "declarations of domicile," criminal pleas, annulments and acknowledgement of a summons as well as official proclamations like "states of emergency" are all "legal declarations." To be legally consequential, you must provably have made such a declaration, usually in writing, and you must have been of sound mind when you did. The Florida declaration that most frequently needs instructions is a "Common-Law Declaration of Trust." This declaration constitutes "public notice as to the purposes and manner of" a business association.

Download a form titled "Affidavit to the Florida Secretary of State to File or Qualify" and an accompanying form titled "Transmittal Letter" from the Florida Department of State website.

Complete the one-page affidavit which asks for the name and address of the association and the name of a person authorized to accept service of process for the association.

Fill in your name, address and phone number on the transmittal letter.

Send the affidavit, transmittal letter and a filing fee of $350 to the Department of State
