Because of the increasing problem of identify theft in the United States, it has become more difficult to obtain a person's birth certificate. Most states issue certified birth certificates only to the individual, a legal representative of the individual or an immediate family member. Laws protecting the privacy of birth records vary from state to state, but there are some requirements that all states share.

Obtain the death certificate of the deceased person from the vital records, health department or records clerk in your state. Make sure that you receive a "certified" copy of the death certificate. Go to your state's vital records page on the Internet to download a printable birth certificate application.

Complete the required application forms to receive the birth certificate. Appear at the office of vital records, health department or records clerk according to your state's requirements. Present a valid photo identification such as a driver license, state issued identification card or a passport.

Complete an online application for the birth certificate of a deceased person if your state permits online applications. Scan your photo identification and the death certificate of the person for whom you want to obtain a birth certificate. Upload your identification if it is requested. Pay the fee to obtain the birth certificate using your credit or debit card.
