How to Write Contract Terms & Conditions

A contract is a legal understanding between parties of a set of terms and conditions that define the relationship between the parties involved in the contract. Different contracts can contain varying material, but there are standard terms and conditions used in every type of contract. Understanding these standard contractual terms can help you better understand the legal agreements you make when signing a contract.

      Outline the specific terms and conditions you need to include in your contract before you begin. This will help ensure you don't leave anything out. There are many different items you might want to include. Some of these items include length of obligation, return policies and pricing policies. In the case of a property rental contract, terms and conditions might include pet and guest policies, smoking policies and yard maintenance terms.

      Write an opening to the contract that identifies the parties under contract and the products or services covered by the contract. This first section of the contract should include the specific date the parties enter into the agreement. Here is an example of an opening:

      This contract, between (company) and (consumer) is entered into on January 1st, 2011, and shall define the conditions of the (services, product or agreement) provided by (company) to (consumer), including all rights and responsibilities of both parties....

      This example is one of many that might be used, depending upon who drafts the contract or if a standard template is used.

      Describe the product, service or agreement in the next section by naming it and giving it a description. State any price terms and delivery terms that apply. If there is a return policy in place, define how returns are made and who is responsible for the shipping. If the contract is for a rental, state the money paid on the contract at the time of signing, as well as the terms of payment and the conditions upon which the rental agreement can be broken.

      State the rights and responsibilities of both parties, including liability for any products and repair that might be necessary. Rights and responsibilities should include those of both parties, clearly defined and in as much detail as possible. The key to contract terms and agreements is to use specific language, which can make defending or upholding a contract, or breaking a contract, easier to do. Vague contracts can be interpreted subjectively, so don't leave room for subjective interpretation.
