A corporation requires you to file articles of incorporation with the California Secretary of State. The advantage of forming your business as a corporation is that it gives you limited liability. A sole proprietorship or partnership is easier to set up; the drawback is that the business owner's personal assets are subject to seizure in a lawsuit.

Choose a DBA or business name, and check its availablility. If you are incorporated, check the Secretary of State's website to make sure the corporate name you want to use is available. Then check the fictitious business names filings at the Sacramento County Business License Unit of the Department of Finance. If the business name you wish to use is taken, you need to come up with another name. File the business name and pay the required fees. If you are using your name as the business name, then you do not need to file a DBA.
