How to Dispute Settlement Rules
The rules and agreements that come about as the result of a settlement are not always favorable to all parties. If neither party challenges the settlement, the agreements made can't be changed unless both parties agree to reopen negotiation. Fortunately, there are provisions for a dissatisfied party to dispute a settlement.

Request an amendment to the settlement proposal that has been set forth by the other party. Indicate the provisions that you disagree with and propose changes to be included in the final agreement. Use straightforward justifications as to why the provisions need to be amended. Consider having direct negotiations with the other party, or use a third-party mediator to present your proposal.

File for a motion to modify through the courts, if the settlement was included in a court judgment. This is a request for the court to overturn certain provisions of a settlement agreement that has already been entered. File the motion in the court where the settlement was reached. On the basis of "unconscionable" rules, show substantial evidence proving that your circumstances have changed, making the settlement rules unfavorable.

Reach agreement with all the parties involved in the settlement or litigation process. Agreeing to amend or modify rules in the settlement is more of an informative process than a confrontational one. Use an attorney to mediate the dispute and to assist you in formulating agreeable terms for the contract.

Draft the settlement using terms and language agreeable to all parties involved. Ensure that the draft agreement is labeled as a modified document and that all parties receive the amended document, consent to it, and sign it. If the rules were only partially amended and the rest of the document is agreeable, indicate this.

Forward the final modified settlement agreement to the courts to indicate that an agreement has been reached. Ensure that a copy of the modified settlement is attached to any motion to dismiss the case and that all parties involved sign a copy of the motion.

Tips & Warnings
Disputing settlement rules is only successful to the extent that the other party agrees to renegotiate terms of the settlement. Final contracts can be difficult to challenge. Consider not being confrontational in the request for modification. This is an effective way to win over the other party.
