Honest communication is the best policy when breaking your lease.

Whether your neighbors are loud, your apartment has an infestation or you simply changed your mind, canceling your signed lease is possible depending on the contract stipulations. Once you sign a rental lease agreement, you have agreed to the conditions of the contract and can be held responsible for your financial obligation. At times, you can work closely with your landlord to develop an arrangement that meets both your needs. Diligent and honest communication is the best approach to get out of a signed lease.

      Read the terms of your lease agreement to gain an understanding of the lease cancellation policy. Some management companies and landlords have strict guidelines written into the signed contract that either allow or prohibit cancellation. Speak with an attorney or review your state's landlord/tenant law (see "Resources") for further clarification.

      Write a letter to the landlord requesting permission to sublet the property. A sublease occurs when the original tenant works with a new tenant to continue rental payments on the property in return for occupancy. Do not sublet the unit until you receive written consent from the landlord to move forward.

      Write a letter requesting the total amount required to break the lease. Many companies and private parties allow tenants to pay a "break lease" fee. They can require payment of one usually substantial amount or the remainder of the lease. Either way, the tenant does not have to worry about credit damage. When requesting information about breaking the lease with a fee, be sure to ask about your security deposit and any other fees.
