How to File a Hardship to Expedite a VA Expense Report
Like many government agencies, the Veterans Administration has lengthy and detailed processes for many of its functions. Veterans' claims for expense reimbursement and other entitled compensations are usually filed for and processed at the end of each year. However, not everyone can wait. In 2008, Congress and the VA created the Expedited Claims Adjudication Initiative to give veterans a faster channel for receiving money due them. It involves a set of fixed deadlines and responses to try to speed things along.

Retain an attorney, veterans service organization representative or accredited agent to represent you in your expedited adjudication claim. The ECA requires representation to participate. If you cannot afford representation, there are nonprofit veterans organizations and even county government programs that can help. For instance, the Cuyahoga County Veterans Service Commission serves veterans in and around Cleveland.

Complete a VA 21-526 form with your expenses and any other eligible claims. The form allows you to account for medical and education expenses that may be reimbursable under VA policies. However, it also requires income reporting to ensure that you actually need, and are entitled to, the assistance.

Complete a VA Form 21-4138 with the assistance or advice of your representative. This form allows you to make a written statement supporting the reasons and circumstances involved in your financial hardship and claim. Adjudicators will likely investigate whatever you write, so construct your statement honestly and thoroughly.

Sign a waiver of your normal application and appeals rights. The ECAI waiver commits you to certain quick response times for the application and appeals processes instead of the usual time frames that give veterans longer to gather evidence and draft responses when queried by the VA. The VA requires the waiver as a condition of ECAI participation because your abridged response time is a major factor in speeding up the process. If you don't feel comfortable or prepared to produce evidence quickly when asked, the ECAI may not be a good choice for you.

Tell your representative to request that your case be processed through the ECAI. Once you receive the letter of permission, you have 30 days in which to file your claim.
