How to Obtain a Copy of a Living Trust in California

California living trusts create separate legal entities that are granted ownership of the assets of the "grantor" or "settlor." The "grantor" or "settlor" normally appoints himself the "trustee," who is charged with controlling the assets owned by the trust. Living trusts are normally revocable while the "trustee" is alive. According to California Probate Code Section 16061.5(a), once the "trustee" dies, the living will becomes irrevocable and the contents are available to any of the beneficiaries upon request.

      Request a copy of the trust from the trustee. The trustee may request a copy of documents proving your identity and right to the information. It may be necessary to present this request in writing with a copy of the probate code and supporting documents attached.
