How to Take Annual Leave While on a Return-to-Work Plan

All companies have different policies concerning annual leave and different numbers of days off. In most companies, the leave is paid. When on a return-to-work plan after a maternity leave or disability leave, annual leave is often still available to the worker. Exact plans differ for each company, but there are ways to take leave on a return-to-work plan.

      Avoid using accrued annual leave before taking other leave, such as medical or maternity leave. Return-to-work plans only occur after work-related injury or illness. If the accrued annual leave is not yet used, it is still available after returning to work.

Most companies will require a two-week notice before allowing the use of annual leave, so inform the company of your desire to take accrued annual leave after starting the return-to-work plan.

      Take the leave when the dates arrive. An employee who takes annual leave beginning of the return-to-work date is considered as starting work, though she is using annual leave. In cases where annual leave is a paid leave, you are paid for the vacation time after the return-to-work date until the annual leave is exhausted and you start working again.
