How to Add a Debt After Filing Bankruptcy in Kentucky
When you file a bankruptcy petition, you must attest in writing that the petition is accurate under the penalty of perjury. However, if you overlook a creditor or a particular debt that you owe, you can usually amend your petition to include the creditor or debt. Although bankruptcy is a federal procedure, Kentucky follows its own local rules to specifically address how to add a debt to your bankruptcy petition after you file.

Verify that the debt is outstanding and valid, and that you know the correct amount. You can usually confirm creditor and debt information by obtaining an updated copy of your credit report.

Confirm the mailing address of the creditor. Large creditors such as credit card companies often have multiple addresses, and one may be preferred for bankruptcy or debt collection purposes. You can usually use the address listed on your credit report, or use the address from the most recent communication you received from the creditor in the mail.

Enter the creditor information on the correct form according to local rules. Per the rules for the Western District of Kentucky, you must file any amendments to your bankruptcy petition using Local Form B. The Eastern District of Kentucky also has its own form for amendments to schedules. Include your bankruptcy case number. You must type and sign your amendment in order for it to be valid. You can get copies of the correct forms from your local bankruptcy clerk or the website for the United States Bankruptcy Court in your district in Kentucky.

Provide a copy of your amendment to your newly listed creditor(s). Before you file a copy with the court, you must mail a copy of the amendment to any creditors you add to the petition. Additionally, you must include a copy of the "Order for Meeting of Creditors" you received when you initially filed your petition. This order notifies creditors of the time and date of your Section 341 Meeting of Creditors, where they are permitted to question you about the information in your petition.

Pay your amendment fee and file your amendment. If you add a creditor to your bankruptcy petition, you must pay a $26 fee, per federal bankruptcy rules. You must pay the fee using a money order or cash only. Pay the fee to the clerk and provide your completed Local Form B.
