How to Stop Your Divorce in Florida

You can end your divorce case if you change your mind.

Couples file for divorce for various reasons, but sometimes spouses reconcile and decide not to move forward with divorce proceedings. If you live in the state of Florida and changed your mind about a divorce you recently filed, there is good news. Dismissing a divorce case is relatively simple and requires less steps than an actual divorce. You can halt your divorce filing with just one form.

Instructions

1. Fill out a Notice of Voluntary Dismissal. If you are the one who petitioned for the divorce and your spouse has filed a counter-petition, she will need to fill out the Notice of Voluntary Dismissal. A notice of dismissal will not dismiss a counter-petition. The form must be printed in black ink or you can type in the fields. If someone who is not a lawyer is helping you fill out the dismissal, they must provide their name and address at the bottom of the form.

2. File your dismissal. Be sure that you file the original copy. To file, go the office of the Clerk of the Circuit Court, where you filed for your divorce case.

3. Present additional copies to all involved parties in your divorce case. You can either mail or hand deliver the Notice of Voluntary Dismissal.
