A levy is a legal device that freezes an asset such as a checking, savings or money market account. Levies are typically the result of a creditor plaintiff's winning a civil court judgment against a debtor defendant and moving to collect the judgment monies awarded by the court. In Texas, such actions are governed by Chapter 34 of the Texas Civil Practice & Remedies Code.

      File a Request for a Writ of Garnishment with the court in which you won the judgment. Take your judgment, go to the Texas court clerk's office and ask for a garnishment request form. Complete the form and file it with the court clerk.

      Receive the garnishment writ and phone the debtor defendant's Texas bank. Ask for the garnishment department or legal department. Mail or fax a copy of the judgment and the garnishment writ to the bank's department with a request for a levy application.

      Complete the bank's levy application and return it to the issuing department. Send a letter to the debtor defendant's official residential Texas address explaining that a levy has been placed against his account and will be held until the judgment is satisfied. Include any exemptions the state authorizes under Chapter 34 of the Texas Civil Practice & Remedies Code.
