Abuse of power of attorney and Medicare have become serious issues. A power of attorney abuse is the misuse by the agent of the authority granted by the principal. Essentially, it occurs when the person appointed is not acting in the best interest of the principal. Although it is often an issue between family members, the abuse is also a crime. Accordingly, it should be reported and prosecuted. Medicare fraud is purposely billing Medicare for services that were never provided or received.

      Research the National Center on Elder Abuse to determine if your community has an established multidisciplinary team (MDT) to address elder abuse. An MDT can be helpful because all necessary parties, such as the prosecutor, case review team, and financial specialists are working together. If your community has an MDT, you should contact them immediately if you suspect abuse of the power of attorney or Medicare. As they have many experts on staff, you will be able to speak with someone with experience in these matters.

      Contact your State's Attorney's Office regarding the abuse of power of attorney. The State's Attorneys Office is responsible for prosecuting criminal offenses, and the power of attorney abuse may qualify as a crime. They may have a Victim Counselor who can assist you. If not, you can speak with a prosecutor. Explain the situation and they will advise you on the proper course of action.

      If you suspect Medicare fraud, you should contact the Office of the Inspector General. Make sure to have as much information as possible to report, such as the provider's name, identifying number, the item in question, and the date of the service. Much of the necessary information is contained in the Medicare Summary Notice, which the beneficiary receives. You can report Medicare fraud confidentially.
