How to Defend Yourself Against a Consumer Lawsuit
In the course of a company doing business, some consumers may take legal action against a corporation to recover money for damages and/or to gain media attention and public interest. A consumer lawsuit does many things to a company including damaging its public reputation and causing it to spend a substantial amount of money to resolve the situation.

Hire an attorney. Immediately retain the services of a consumer law attorney who has extensive litigation, settlement and trial experience. Discuss the lawsuit openly and honestly. Give the attorney access to all records, procedures and employees related to the consumer lawsuit.

Secure the services of a professional public relations agent. Inquire about how to minimize public backlash and communicate to the public that the company is committed to settling the consumer lawsuit and working with the plaintiffs to make sure the problem is resolved into the future.

Communicate a settlement offer. Through your legal counsel, offer to settle the lawsuit outside the court with the consumer or consumer advocacy group. Include a nondisclosure agreement to keep the details of the settlement confidential.

File a counterclaim. If the claim is frivolous or causes slander or libel, inform the plaintiff through the company's attorney that a counterclaim will be filed against him or the advocacy group unless the consumer lawsuit is withdrawn from the court.
