A signed legal agreement is a contract. A contract is created by an offer, acceptance of the offer and consideration. In general, the contract is an exchange of promises to do, or forbear from doing, something. When a contract is breached, the breaching party must put the non-breaching party in the same position that he would have been in had the contract been fulfilled. If you have entered into a contract with another person and he is threatening to breach, there are a series of steps that you can take to attempt to have him adhere to the contract.

      Contact the other party and request that he adhere to the contract. If the other party is threatening to breach the contract, find out why and attempt to persuade him to adhere to the contract.

      Have your attorney contact the other party. If, after talking to the other party, he still intends on breaching the contract, have your attorney call or send a letter. If you can resolve the issue before the contract is breached, it will save you time, court costs and additional attorney's fees.

      Sue if the contract is breached. If the other party breaches the contract, sue for a remedy that will make you whole. Depending on the type of contract, you may receive money to pay for a substitute to complete the contract or, in some cases, to have the party perform the contract. Consult your attorney to determine the best remedy.
