Maryland is one of only three states that recognizes same-sex marriages from other states.

Although Maryland does not yet allow same-sex couples to be married, it does recognize out-of-state same-sex marriages and allow for domestic partnerships within the state. In Maryland, domestic partnerships afford same-sex couples some of the rights granted to heterosexual married couples. These rights include the right to hospital visitation, cohabitation in nursing facilities, disposal of your partner's body, the ability to make decisions during a medical emergency and the ability to be added or removed from housing deeds without penalty. Maryland does not have a domestic partnership registry.

      Write a statement declaring that you and your partner are in a domestic partnership. To qualify, you must be over 18 years of age, not related by blood or marriage and not married or in a civil partnership with another person.

      Have the notary of the public notarize your statement.

    • 3

      Collect at least two pieces of evidence proving your domestic partnership. Qualifying evidence includes shared bills, co-ownership of real estate or a joint checking or savings account. Keep these items along with your notarized statement.

      There is no formalized registry in Maryland, so the notarized statement and supporting documents should be kept on file to be presented when needed.
