Texas is a great state in which to operate a gun business. Texas is business friendly and has minimal restrictions on firearms. When starting a gun business, you may wish to include online selling and gun brokerage services to expand your customer base beyond the borders of Texas. As a gun dealer you have the option of starting small –operating from your home –or setting up a storefront. If you plan to open a store, you should check with your local authorities concerning zoning rules for your store’s location.

Register for an Assumed Name Certificate (ANC) in the county where you plan to do business. An ANC establishes your business name.

Apply for a Federal Firearms License from the Bureau of Alcohol, Tobacco and Firearms (BATF). Request an application by calling the BATF at 301-583-4696. FFL applications are usually processed within 60 days.

If your business is other than a sole proprietorship, then you must register your business with the Texas Division of Corporations. The majority of start-up gun shops are the sole proprietorships.

Apply for a Sales and Use Tax Permit from the Texas Tax Commission. A Sales and Use Tax Permit authorizes you to collect sales tax on goods and services on behalf of the state of Texas.

Apply with the Internal Revenue Service for an Employer Identification Number. An EIN is necessary if you plan to hire employees (contact the IRS by calling: 800-829-4933).
