Your request is likely to be approved if neither party has resided in the current jurisdiction within the past six months, and if one or more parties have lived in the county that the case is to be transferred to for at least the past six months. You are not eligible to change venue to a county that is adjacent to the county that is currently hearing your case.

      Acquire a State of Michigan Petition and Order to Change Venue form. You may acquire this form at the office of any Michigan county court or you may download it from a Michigan courts website (see Resource).

      Fill out all information requested by the form. Note the reason for your request in Box 2 and indicate the county that you want the venue changed to in Box 4. Both you and your attorney must sign the bottom of the form.

      File the petition with the county court currently assigned to your case. The court will determine whether the case should be transferred to the jurisdiction that you have specified. If the case is transferred, the new county will have full jurisdiction over your divorce case.
