When a child's parents already live apart or go through a divorce, they must establish a child custody and support arrangement to share parental rights and responsibilities. Either parent can file a petition for custody and ask for support payments from the other parent. In New Mexico, the state district courts make child support orders. A parent can also initiate proceedings through the state's Child Support Enforcement Division, but it may take longer to get a child support order that way.

      Negotiate with the other parent, working with a mediator if necessary, to fill out Form 4A-313: Parenting Plan and Child Support Obligation, Domestic Relations, which is required in New Mexico as part of divorce cases involving children and child paternity cases. Arrange for the child's legal custody, time sharing for regular weeks, holiday schedule, communication, expenses and dispute resolution. Complete and attach a child support worksheet to your parenting plan if you can agree on the terms together, state when child support payments will end and note whether you agree to wage withholding for payments.
