How to Patent Online

How to Patent Online thumbnail
Patent applications are now being accepted online at the USPTO website.

A patent is a legal right granted to you by the U.S. government via the Patent and Trademark Office (USPTO), which governs the ownership of an invention or product design. When you own a patent on an item, only you have the legal right to manufacture and sell this product. Patent applications are now being accepted online via the USPTO's website through its electronic filing system (EFS).

Instructions

    • 1

Launch the EFS system for unregistered patent applicants. File for a customer number, digital certificate and corresponding password. This will act as your username and password when you wish to log in to the USPTO patent filing system.

    • 2

Select "New Patent Application" if you wish to start your application simultaneously as you register for your customer number. You will be redirected to the patent application process screen. Alternatively, you may return at a later time and input your certificate and password information when you log in as a returning registered user.

    • 3

Follow the step-by-step patent filing instructions through the EFS site after you have logged in. You will be asked to provide specific dates, product descriptions, photos and proof that the idea is truly yours.

    • 4

Check the status of your patent application regularly online. Use your customer number, digital certificate and password to access these records.

    • 5

File additional patents using the same customer number, digital certificate and password you obtained during your first registration.

    • 6

File additional paperwork requested, or submit an appeal using the provided link in your application rejection email using the same login information you have been using.
