How Do I Expunge a Record in Brevard County, Florida?
If you were arrested in Brevard County, Florida, but the charges were never filed or dismissed or you were acquitted at trial, then you may be eligible to have your record expunged. The state of Florida does not allow convictions to be expunged. If the record of your arrest is expunged successful then the public will not have access to the record, and law enforcement agencies only will receive a message that the record has been expunged.

Complete the application to the Florida Department of Law Enforcement (FDLE) for a certificate of eligibility. Your signature on the application form must be notarized. The fee for the certificate was $75, as of 2010, and the form can be found on the FDLE website.

Submit the application to the state attorney or statewide prosecutor. He must check the appropriate box in Section B and sign the form.

Obtain fingerprints from an authorized law enforcement agency. The fingerprint form will be included with the certificate of eligibility form.

Request a certified disposition of the case that you are seeking to have expunged. Check with the court clerk for Brevard County for instructions on how to get a certified copy. That office can be reached at 321-637-5413. If you completed a pre-trial intervention or other diversion program, you may obtain a certified letter of completion from the state's attorney's office in lieu of a certified disposition. If you completed probation, you will also need a certified copy of your termination of probation.

Complete a petition for expunction once you have received your certificate of eligibility from the FDLE. The certificate does not guarantee that your record will be expunged; it merely affirms that you are statutorily eligible. File the petition along with the certificate of eligibility with the Brevard County court clerk.
