How do I Divorce in Hindi?
The divorce rate in India has grown over the past few years. This may be due to women claiming their independence. Women are no longer willing to go along with the traditional views that Indian men have. As Indian women became educated and began earning their own money, they became less likely to compromise themselves and adhere to old-fashioned rules.
A newly married Hindu couple cannot file for divorce within their first year of marriage. A divorced couple is allowed to remarry as long as all of the divorce proceedings are over and there will not be an appeal. Under Hindu law, divorce is not allowed on some grounds. Since the religion does not approve of a married couple getting divorced, it's difficult to carry one out. According to Hinduism, marriage is sacred, for the purpose of continuing a family. The Hindu Marriage Act of 1955 says that the couple can be legally separated under certain conditions. Moreover, divorce is allowed if adultery, cruelty, desertion, mental problems, change of religion, disease or physical separation has occurred.

Seek legal separation if you and your partner have been not living together for at least one year. You and your partner must also agree that your relationship has dissolved beyond repair.

File for divorce in court. If the divorce is by mutual consent, file a petition for divorce under Section 13B of the Hindu Marriage Act. The divorce has to be filed in the area where the couple last resided together, or where they were married.

Apply for divorce if bigamy has been committed in the relationship. The Indian Penal Code defines bigamy as a punishable offense.

File for alimony as the aggrieved party of the divorce. The court may rule that the aggrieved partner should be paid a monthly sum.

Tips & Warnings
If possible, it's suggested to avoid divorce under Hindu law. Couples may be able to do this by balancing priorities and being sensitive to their marriage, particularly when large decisions are at stake.
The husband and wife must live separately for one year before being able to file for divorce. The process overall takes approximately one year.
