Visit your Secretary of State website and conduct a business entity search for your current business name. Corporations cannot share the same name in one state. Click on the corporations division and click "business entity search". Type in the name of your intended business name and click "search". If no business name is found you are free to use that business name.

Draft your articles of incorporation. Your articles incorporation includes the name of your corporation, the number of shares issued (if any) the address the business will operate as well as any specific details about the business. Hire an attorney to draft the articles of Incorporation for you, or your check your Secretary of State's website as they may offer free templates for the articles of incorporation if you choose to file online.

Pay any filing fees to incorporate. Filing fees vary from state to state. For example, to incorporate in Delaware filing fees start at $89 and Nevada fees can start at $200. Pay filing fees in the form of a check or money order if filing through the mail or use a major credit card if filing online.

Keep records of any confirmation numbers or receipts after paying your filing fee. The receipts will protect you if the Secretary of State has a computer issue or if other businesses you want to work with needs to verify you have filed your articles of incorporation.
