How to Register a Trade Name in Nevada
While you are not required to register a trade name in Nevada, one of the most important benefits of registration is that it will prevent someone else from using the same trade name for his business. Registering your trade name is accomplished by filing an application with the Secretary of State. Once your registration is completed, your trade name will be certified for five years.

Choose a trade name and check for its availability. Using the business name, search database maintained by the Secretary of State and see if your proposed trade name is already in use. If so, you will not be able to use that trade name.

Begin using your trade name. Include it in any advertising or marketing campaigns you are considering. Add it to official correspondence such as letterhead. Under Nevada law, only trade names in actual use can be registered.

Obtain a "Mark Registration" form from the Secretary of State. The form is available on the Secretary's website or you can obtain a hard copy from the Las Vegas Commercial Recording Division.

Fill out the form completely. In addition to asking you specific information about your business and the trade name, you will also need to provide the date you began using the trade name, how you plan to use the trade name and a picture or drawing of the trade name if it has a specific design.

Notarize your completed form. Under Nevada law, a non-notarized form will not be accepted. The full name and signature of the person signing the form must be included.

File the form with the Secretary of State along with any applicable fees. As of July 2009, applications are processed through the Las Vegas Commercial Recording Division. Filing can be completed by fax, mail or in person.
