How to Obtain a Marriage License in Virginia
As long as you and your intended spouse are at least age 16, with the consent of a parent or guardian, or age 18, and have no previous unresolved legal issues pertaining to a previous marriage, you are free to marry in the state of Virginia. To obtain a marriage license, go to the circuit court in any county in Virginia. You do not have to have your marriage ceremony in the same county where you receive your license. Once the license is issued, you must hold a ceremony overseen by an ordained religious leader or a designated civil servant, such as a justice of the peace.

Find a church or civil leader with the legal authority to perform marriage ceremonies. Find out what she charges and be prepared to pay right away. The charge to perform a marriage cannot exceed $50. You will have to schedule your marriage ceremony to take place within two months, or 60 days, of receiving your marriage license. If you do not wish to have a private ceremony, find out from the deputy clerk at the circuit court's office whether the judge presiding over the courthouse would be willing to perform the marriage rites in court.

Collect any paperwork you and your fiancé have pertaining to any previous marriages. Bring proof of age and identity to the Virginia courthouse where you hope to obtain your marriage license. Anyone age 16 or 17 must have a parent or guardian accompany them to sign a consent form.
You may also be asked to pay a fee, and the fees vary from county to county. Call ahead to find our hours and fees. Note that if there is any complication regarding a divorce case still pending, the marriage license may be held until these issues are resolved.

Fill out the marriage certificate and return it to the courthouse within five days after the marriage ceremony. This allows the state to log your official certificate of marriage with the state's Office of Vital Records. Anytime in the future that you wish to receive a copy of your marriage certificate, you may contact the Virginia State Office of Vital Records and make a formal request. Marriage certificates are only available in the state where the marriage was performed, even if you live elsewhere.

Tips & Warnings
If the female is pregnant, the age requirement of sixteen may be waived.
No witness is necessary at the time of the wedding ceremony, and no blood test is required.
