You have the right to refuse a Breathalyzer test.

A Breathalyzer is a device most often used to determine the blood alcohol level of someone suspected of driving a car while intoxicated. While the accuracy of these devices are debated, they are a generally accepted means of measuring blood alcohol levels. You may refuse to submit to a breathalyzer test if you wish, although you may incur more severe penalties for doing so. Laws vary from state to state.

      Research the laws for your state and county. Often refusing to submit to a Breathalyzer test can automatically result in arrest or suspension of license.

      Follow all instructions given by a police officer if you are pulled over. Provide the officer with your license, registration and proof of insurance if asked.

      Respectfully decline if asked to submit to a Breathalyzer test. Ask the officer to explain the consequences of doing so if you do not already know.
