How to Get Rid of a Speeding Ticket in Ontario
Local police departments and the Ontario Provincial Police retain the right to give speeding tickets to anyone who does not adhere to posted speed limits. Throughout the province, urban area roads have a speed limit of 50 miles per hour (mp/h) unless otherwise posted. Rural roads in Ontario have a speed limit of 80 mp/h unless otherwise posted. The police enforce these limits by routinely monitoring all roadways in Ontario. Police issue speeding tickets as a control measure and deterrent. Tickets may either be settled through acceptance and payment or by appeal.

Decide between legal representation or self representation. Many agencies are available throughout Ontario to offer advice and/or court representation to contest a speeding ticket. Self representation requires quite a bit of knowledge of the traffic court system and is not the most feasible option for most individuals. Legal representation through an agency offers expertise and plenty of experience with police, courts and tickets in general. Using an agency comes with a cost. However, the cost is usually worth it because an agency with experience can often win the case for you.

Discuss the explanation and defense strategies to use in traffic court. Explanations should not be used as a sole defense, as this is a blatant emission of guilt. Instead, agency representatives can identify administrative errors on the ticket or other defense mechanisms. The possible options of a defense depend on each specific case. They can include arguing against incorrect police action, unnecessary force by the issuing officer, or an eyewitness account of innocence by a bystander.

Attend traffic court. A Justice of the Peace will preside over the case in which you must prove that the ticket and the ensuing fine and demerit points should be eliminated. The issuing cop is also mandated to attend. If the cop does not attend, the judge may immediately cancel the ticket or request a remand.

Prove your case. Convince the Justice of the Peace using the defense.

Listen to the Justice of the Peace's decision. The judge will decide if the ticket will be dismissed or if it remains payable.

This incorrectly states speed limits on Canadian roads in 'Miles Per Hour'. Canadian roads employ the use of 'Kilometers Per Hour', which is a measurement of speed defined under the Metric system.
