How to File in Small Claims Court in AZ
Small claims courts simplify the legal process so that parties involved in a dispute can present their cases without a lawyer and receive a fast resolution. Small claims courts in Arizona are a division of justice of the peace courts. They typically handle cases involving property damage, personal injury, cancellation of a contract and money debts. Claimants can file a case if the amount of the claim does not exceed $2,500.

File a complaint. You must file this complaint with the clerk of the Arizona small claims court in the city where the defendant resides or works. You can also file in the city where the incident occurred. Information required on the complaint includes the name and address of the defendant, a summary of the complaint and the amount you are claiming.

Pay the fee. The amount will vary by the court in which you file. When you file and pay the fee, the clerk will give you a date for the hearing and issue a summons ordering the defendant to appear in court.

Serve the summons and complaint on the defendant. You can do this by registered or certified mail with return receipt requested. You will incur an additional fee if the court serves the defendant on your behalf.

Go to the small claims court on the date of the hearing. The judge will listen to both sides and issue a judgment. The judge may order the losing party to pay the costs of the winning side.
