If you and your spouse are both in agreement that your marriage has come to an end and that you wish to get a divorce in California, you can obtain a divorce in a relatively short period of time. California is one of many states that always couples to get a "no fault" divorce, which makes the process faster. If you qualify to file a Joint Petition for Summary Dissolution, your divorce can be final in as little as six months.

Instructions

      Decide in which county your will file your divorce. One of you must have lived in California for the preceding six months and in the county where you file for three months.

      Determine whether you qualify to file a Joint Petition for Summary Dissolution (JPSD). In order to file a JPSD, you must meet the following conditions: be married less than five years; have no children from the marriage; have no real estate; owe less than $6,000 in joint debt; own less than $38,000 worth of property acquired during marriage; have no seperate property worth more than $38,000; require no spousal support; sign a joint petition and sign an agreement dividing all assets and debts.

      Prepare a Joint Petition for Summary Dissolution. All necessary forms can be found on the California Courts self-help website. (see Resources) Both husband and wife must sign the petition.

      Make several copies of the petition. File the petition with the clerk's office in the county where one of you has resided for the past three months.

      Wait the required six month period after the filing of the petition.

      Prepare and file a Request for Judgment, Judgment of Dissolution of Marriage and Notice of Entry of Judgment. When the court returns a copy of the judgment signed by the judge you are legally divorced.
