How to Get an Annulment in Nevada
For multiple reasons, marriages come to an end. The reasons for this may vary. The standard way to end marriages in Nevada is a divorce. Some participants, especially those who are of certain faiths (like Catholicism) prefer an annulment to a divorce. An annulment essentially treats the marriage as if it never happened. The grounds for annulment include lack of consent of parent or guardian (if one of the participants was under 18), lack of understanding (mental insanity), fraud, spouses related by blood, or either party was already married. One spouse must have lived in Nevada for at least six weeks prior to the filing of the annulment, or the wedding must have taken place in Nevada.

File a complaint for annulment. The fee is $147. Only one spouse has to file the complaint. The person who files is the plaintiff. When the paperwork is filed the case is issued a judge and a case number.

Personally serve the defendant with the papers for annulment. Nevada requires that the plaintiff has a third party serve the defendant with the annulment complaint. This can be accomplished by hiring a process server.

Serve the defendant with the annulment complaint. The defendant has 20 days to file an answer with the court. If the defendant desires relief (monetary compensation) or to file an additional claim, they have the right to do so. It costs $95.00 to file an answer. If no answer is filed, the plaintiff may obtain a default judgment. The plaintiff may prepare the default paperwork in anticipation of no answer from the defendant.

Take the completed default paperwork to the legal filing center at the Clerk's office. Once the clerk sees it has been 20 days since the defendant was served, he will issue the default. The plaintiff can get a decree of annulment from the court once the default is granted.
