How to Register a Business Name in Western Australia

An essential part of starting a business is picking out a name for it--this typically takes a great deal of thought and is important, since it will be the means by which the world recognizes your company. In Western Australia, business names must be registered through the Department of Commerce. The process for registering a business name is fairly straightforward.

      Contact IP Australia at 1300 65 10 10 to determine whether the name you have in mind is trademarked. The Western Australia Department of Commerce does not check for copyright infringement when they process applications--it is your responsibility.

      Search through the Australian Securities and Investments Commission National Name Index (see Resources) to see whether the name you want to register is already in use. Similar names can be registered, but identical ones cannot. For example, if a business already exists with the name "Sally's Fruits," you can still register the name "Sally's Sensational Fruits."

      Fill out Form 1, "Application for Registration of a Business Name," in its entirety. This form can be obtained from the official Western Australia Department of Commerce website (see References).

      Make a copy of your completed form for your records. You will need to send the original, as copies are not accepted for registration.

      Mail Form 1 to the appropriate regional Consumer Protection office address listed on the right side of the form along with the appropriate fee--faxed and emailed forms are not accepted. It costs $90 to register a business name, an optional $3 to have your certificate laminated and $5 extra for an extract, which is also optional.

      Wait until you receive your registration certificate before purchasing any business signage or stationery, such as brochures and business cards. In the event the name you want cannot be registered, you will lose the money you spent.
